Terms of Service

Agreement for Use of the NCTSA Member Portal, Services, and Events

1. Acceptance of Terms

Welcome to the Nyandarua County Tertiary Students Association (hereinafter "NCTSA," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of the NCTSA Member Portal (the "Portal"), our website located at nctsa.co.ke, our mobile application, and all associated services, content, and events (collectively, the "Services")[citation:1][citation:5].

By registering an account, accessing the Portal, or using any of our Services, you confirm that you are a student or alumnus from Nyandarua County, are at least 18 years of age, and agree to be bound by these Terms in their entirety[citation:1][citation:3]. If you are using the Services on behalf of an institution or organization, you represent that you have the authority to bind that entity to these Terms. If you do not agree to all the terms and conditions, you must not access or use our Services.

2. Membership Eligibility and Account

2.1 Eligibility

Membership and use of the Services are exclusively available to:

  • Students currently enrolled in a recognized university, college, or tertiary institution who hail from Nyandarua County[citation:1].
  • Alumni of tertiary institutions who originate from Nyandarua County[citation:1][citation:3].
  • Prospective members who meet the above criteria and are in the process of application verification.

2.2 Account Registration and Security

You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate[citation:1]. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must immediately notify NCTSA at support@nctsa.co.ke of any unauthorized use of your account or any other security breach[citation:5]. NCTSA reserves the right to suspend or terminate any account that provides false information or is used for unauthorized purposes.

3. Description of Services

NCTSA provides a platform to empower students through connection, support, and representation[citation:1]. Our Services include, but are not limited to:

  • Member Portal: A dedicated platform for member profiles, event registration, and resource access.
  • Events and Activities: Organizing academic, social, cultural, and career-oriented events such as workshops, talent shows, and networking forums[citation:1].
  • Career and Opportunity Hub: Posting job opportunities, internships, and facilitating mentorship connections[citation:1][citation:5].
  • Advocacy and Representation: Serving as a unified voice for student welfare and interests[citation:1][citation:3].
  • Information Dissemination: Providing news on scholarships, bursaries, and county-related opportunities[citation:5].

We reserve the right to modify, suspend, or discontinue any part of the Services at any time without prior notice.

4. User Conduct and Responsibilities

As a condition of using our Services, you agree not to:

  • Use the Services for any illegal purpose or in violation of any local, national, or international law.
  • Harass, abuse, threaten, or impersonate other members, NCTSA staff, or elected leaders.
  • Upload or share content that is defamatory, obscene, infringing, or otherwise objectionable.
  • Attempt to gain unauthorized access to other members' accounts, or to the association's systems or data.
  • Disrupt the integrity or performance of the Services or the data contained therein.
  • Misrepresent your identity, student status, or affiliation with Nyandarua County.

Violation of these conduct rules may result in immediate termination of your account and access to Services, and may be reported to relevant authorities or your educational institution.

5. Events, Registrations, and Payments

5.1 Event Participation

NCTSA organizes various events for members[citation:1]. By registering for an event, you agree to any specific terms, conditions, or codes of conduct advertised for that event. You are responsible for ensuring you meet any eligibility criteria (e.g., year of study, institution) before registering.

5.2 Payments and Refunds

Some events or services may require a fee. All payments must be made through the designated official channels (e.g., MPESA). Payment instructions will be provided during registration. Refund policies are event-specific and will be clearly stated prior to payment. NCTSA is not liable for transactions processed by third-party payment providers.

6. Intellectual Property Rights

The Services, including the Portal's design, logo, text, graphics, and software, are the property of NCTSA or its licensors and are protected by copyright and other intellectual property laws[citation:3]. The name "Nyandarua County Tertiary Students Association," "NCTSA," and associated logos are trademarks of the association.

You are granted a limited, non-exclusive, non-transferable license to access and use the Services for personal, non-commercial purposes related to your membership. You may not copy, modify, distribute, sell, or lease any part of our Services without explicit written permission.

7. Third-Party Links and Content

Our Services may contain links to third-party websites, job postings, or resources (e.g., scholarship providers, employers)[citation:5]. These links are provided for your convenience only. NCTSA does not endorse and is not responsible for the content, privacy policies, or practices of any third-party sites. You access such links at your own risk.

8. Disclaimer of Warranties and Limitation of Liability

8.1 "As Is" Service

The Services are provided on an "AS IS" and "AS AVAILABLE" basis. NCTSA expressly disclaims all warranties of any kind, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or secure.

8.2 Limitation of Liability

To the fullest extent permitted by law, NCTSA, its elected leaders, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Services. This includes, but is not limited to, damages or loss of data, or other intangibles, even if advised of the possibility of such damages.

Our total liability for any claim arising under these Terms shall not exceed the total amount of fees you have paid to NCTSA in the twelve (12) months preceding the claim.

9. Termination

These Terms are effective until terminated. You may terminate your account at any time by contacting us at support@nctsa.co.ke[citation:5]. NCTSA reserves the right to suspend or terminate your account and access to the Services immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Services will cease immediately.

10. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Kenya, without regard to its conflict of law provisions. Any dispute arising from these Terms or your use of the Services shall be subject to the exclusive jurisdiction of the courts located in Nyandarua County.

You agree that prior to filing any formal claim, you will contact NCTSA to attempt to resolve the dispute informally. Our contact information is provided in Section 12.

11. Amendments to Terms

NCTSA reserves the right, at its sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least thirty (30) days' notice prior to any new terms taking effect, either by posting a notice on the Portal or by sending an email to the address associated with your account. What constitutes a material change will be determined at our sole discretion. Your continued use of the Services after the effective date of the revised Terms constitutes acceptance of the changes.
